These Terms and Conditions of Use and Disclaimer (the "Terms") govern the use and access to the web site www.gpsag.ch (the "Site"). In addition to the Terms a number of additional documents apply to registered users of the Site. The User will be asked to separately accept those documents before being accepted as a Registered User of the Site.


1. Legal Disclaimer

The Site is the official site of Global Projects Services ("GPS"), Uetlibergstrasse 134, CH-8045 Zürich (Switzerland). The information provided on the Site is provided solely for the reader's general knowledge. The information is not intended to be a comprehensive review of all matters and developments concerning GPS and GPS assumes no responsibility for its completeness, accuracy and currency.

Users agree that they will not use any robot, spider, other automatic device, or manual process to monitor or copy GPS's web pages or the content hereof without GPS's prior expressed written permission. Users agree that they will not use any device, software or routine to interfere or attempt to interfere with the proper working of the Site or any auction being conducted on the Site. Users agree that they will not take any action that imposes an unreasonable or disproportionately large load on GPS's infrastructure. Much of the information on GPS's site is updated on a real time basis and is proprietary or is licensed to GPS by GPS's Users or third parties. Users agree that they will not copy, reproduce, alter, modify, create derivative works, or publicly display any content from the Site without the prior expressed written permission of GPS or of the appropriate third party.


4. Site Protected By Copyright And Trademark

All material on the Site is protected by copyright. The material may be used and copied for non-commercial, personal or educational purposes, provided that this material is not modified and that copyright or trademark notices are not deleted. Any other use of this material without GPS's written permission is prohibited. Such permission can be obtained by contacting info@gpsag.ch.

Except as otherwise noted, the trademark and logos displayed on the Site belong to GPS and may not be used without GPS's written permission.

All third party content published or posted by GPS on the Site is the property of the respective copyright owner and no User is permitted to copy and/or distribute such contents for commercial purposes. Any User copying or distributing third party content shall be liable for all legal consequences, GPS having no responsibility whatsoever therefor.


5. User Information

With the sole exception of information provided to GPS through the Recruitment Form [http://www.gpsag.ch/form] which are subject to the GPS Privacy Notice [http://www.gpsag.ch/privacy], any User providing information (including questions, comments or suggestions) to GPS through the Site agrees that GPS shall have no obligation of any kind with respect to such information and shall have no liability in respect of the content of such information. GPS shall be free to reproduce, use, disclose and distribute such information to others without limitations. Such information provided by the visitor shall be deemed to be non-confidential. Any information sent to GPS must be truthful, legal and not violate the rights of others.


6. Amendments

GPS reserves its right to review and amend the Terms from time to time. The User shall check back the Site periodically in order to verify if any changes have been implemented. The changes will be posted on the Site 20 (twenty) days prior to their implementation, it being understood that GPS reserves its right to inform the User by using the e-mail provided by the User in the registration form.


7. Applicable Law and Exclusive Jurisdiction

These Terms as well as any dispute related to the construction, interpretation or execution hereof are subject to Swiss Law, with the exclusion of the conflict of laws rules. The Courts of Zurich, Switzerland, shall have exclusive jurisdiction in case of disputes.
